The new unfair competition law
The unfair competition act has been amended at the end of the year 2008. As a result, companies have to adapt their advertising as competitors will observe it thoroughly and may even send warnings / orders to cease and desist.
The amendment added a black list of advertisings/acts of competition whichhave to be regarded as unfair competition without exemption.

Transformation into mp3-files: Reformation or duplication?
Does the competence of the German society for musical performing and mechanical reproduction rights (GEMA) include the transformation into mp3-files? If the answer is no, a retailer/barkeeper may be forced to ask each author for a separate licence for each song he has transformed into a mp3-file.
Because of this immense effect in practice the categorisation of transformation into a mp3-file as a reformation or duplication in German copyright law is essential. If the transformation into a mp3-file can be regarded as a duplication, the GEMA would be responsible for this act. In case the transformation has to be considered as a reformation there would be no responsibility of the GEMA. The latter classification as a reformation may lead to almost irresolvable problems for each user even for those, who are lawful owner of a CD and like to transform those songs into a mp3-file. In this eBook, which is also a master thesis, this problem has to be solved with the help of several practical examples.
